Department of Legal Affairs

 

Department of Legal Affairs is the most dynamic department in the University of Baghdad, according to the nature of the tasks entrusted to the department in question, and its administrative organizational structure is connected to the President of the university directly.The nature of the work of the Department:
First: the organizational structure of the department:
Director of the Section
Division of Public Opinion (It renders an opinion and the preparation of Legal Studies)
Rights Division consists of two units (unit committees and investigative unit cases) and conduct follow-up Human League
Housing and property consists of two units ( housing unit, and property unit) is following up on all matters pertaining to the property of the university
Unit Secretariat (organizing the incoming mail to the legal department and follow up the staff)
Follow-up of administrative units (the archives and preservation of official mail and follow-up responses and correspondence)
Legal Unit of the scientific research centers (the follow-up of Legal Affairs for the research centers)
Second: The achievements of the department:
Department of Legal Affairs in the presidency of the university achieved the following:
University property
The Legal Department and the Department of Engineering discovered lands belonging to the university and the vast areas identified by (2076) acres in the area of Amiriya, and (150) acres in the area of Khan Beni Saad, and research and exploration in the yellow books belonging to the real estate departments.
Investigative committees: note by the Department of Legal Affairs to form investigative committees in the central issues that are repeated more than once, including: –
the investigative staff of the central discipline of the service university
the investigative cases for the diagnosis of central administrative and financial corruption
the central investigative documents for fraudulent academic staf
investigative Central Committee of combining study and employment
Central Investigative Committee to consider in determining responsibility for the administrative body not to issue a referral to retirement for employees who have completed the legal age of retirement
the investigative committee to follow up on investigative committees for late completion of its work
Notes by Department of Legal Affairs to conduct field visits to some of the formations of the university in crisis management and legal signature of the site and condemned as a legal representative of that composition for the organization of work and overcome the crisis
the formation of a joint working group with the Office of the Inspector General at the Ministry of Higher Education and Scientific Research for the purpose of resolving all issues related to the university and private formations
Legal Studies:
Legal Affairs Department has offered a number of legal studies which contributed in organizing the work of the University, including the following:
Study of legal status regulations governing the work of the special investigative committees of study documents that were forged to the ministry
the study of legal controls granting career are serculated by the ministry to the ministry of all formations
the study on the determination of legal rights and privileges of the holders of Higher Diploma from the Higher Institute of Studies Accounting and Finance
legal study in the implementation of the provisions of the law of retirement (retirement / extension / disengagement)
lawsuits:
Lawsuits filed by third parties before the public discipline in 2010, 44 of which 28 settled a lawsuit filed on behalf of the university, while the remaining cases and the 16 in the proceedings.
As for the civil lawsuit filed by the presidency of the university, they have reached (30) an action for 2008/2009 / 2010 of which 19 cases resolved in favor of the university and 11 are under judicial proceedings
As for the lawsuits filed in 2011 by the University, there are 11 cases under judicial proceedings
Organizational Structure:
Legal Council:
The legal council at the presidency of the University of Baghdad was formed as there were some reasons for its development This was done for the purpose of unification of legal policy for all sections of the university and move away from unilateral decision-making and give it to the authority of the group for the purpose of scheduling the meeting officials. the sections and the legal units in the formations of the university and the activation of the legal culture and the media legal between members of the university for the purpose of activating the role of legal controls on the management and crisis management, legal, with some formations of our university, God forbid, and the number of legal studies and draft laws, including contributing to the development of higher education in our beloved country For the purpose of developing the efficiency of the employee on behalf of human rights, including the university and all the institutions of the state. It was found that human resources are grouped in the Legal Council called upon the legal Council.
Legal Unit of the Centre for Scientific Research:
The purpose behind its development is to launch the independence of the formations of the university in terms of legal, financial and administrative officer of the formations under the provisions of Article (10) of the Act and the Ministry of Higher Education and Scientific Research, No. 40 of 1988.
Legal services in the formations of the university has been obtaining the approval of the Ministry of the Legal Department and administrative under her No. (23 204) on 1/9/2009 to make the organizational structure of the Chambers legal in colleges and institutions of the University at the division level and is already changing the organizational structure of colleges and gradually, as the case of college and the availability of human resources, and that the purpose of its establishment is the expanding of the tasks assigned to these configurations.
