As approved by the house of representatives in accordance with the provisions of item (I) of article (61) and item (iii) of article (73) of the constitution. The president of the republic decided on 18/11/2012
issuing of the following act:
The second amendment of the university service law, No. (23) in 2008
Article (1)
Modifying the first, second and third and seventh of article (1) of the first amendment of the university service act, NO. (23) in 2012 and be replaced by the following:
Employee of the university service act is referred to retirement when when he is up to the age of (65) years and the age (70) years for holder of scientific title of professor or associate professor and to the council of the university or the board has the commission to extend his university service for a period not exceeding (5) years for professor or associate professor as needed based on a written request or a recommendation of the council of the college or the institute and acknowledgement from the relevant medical committee.
The retired since 1/1/2015 who didn’t come back to his job is included in the privileges provided for in this act and continues to receive his pension.
Employee of the university service is granted a reward (4,000,000) dinars for each research published in international journals with impact factor (that is known universally as a rating for sobriety of the journal).
the university council or the board with a recommendation of the council of the college or the institute has the commission to reinstate the university service employee who cut off his relationship with his job before the entry into force of this act who has not yet reached the legal age of retirement provided for in this act, or who retired based on the first amendment of the university service act, NO. (32) in 2012.
Article (2)
Modifying article (2) of the first amendment of the university service act NO. (32) in 2012 and be replaced by the following:
Employee of the university service or his dependants receive a pension by 80% of the total salary, university service and school certificate allocations when referred to retirement in one of the following cases:
If referred to retirement for completing the legal age and has a university service of not less than (25) years including at least (10) years in university service.
If referred to retirement for health reasons due to inability to perform his duties by decision of the relevant medical committee regardless of length of service or age.
If referred to retirement at his own request, provided that he has a university service of not less than (25) years.
If he died in service regardless of service or age.
The service of assistant researcher in Iraqi universities and institutes is considered a university service for retirement purposes since his appointment after obtaining a master’s degree or equivalent provided that he would serve afterwards for at least (10) years before reaching the legal retirement age and that he has pension service not less than (25) years.
Article (3)
This act takes effect from the date of its publication in the official gazette.

Binding reasons:
In appreciation for the efforts of Iraqi scientific personnel in Iraq, for the encouragement of scientific research, to set a solid scientific base, to provide opportunities for the support of the members of faculty who have scientific titles, attracting them and to address the subject of their retirement, this act has been enacted.
