Based on what was approved by the house of representatives in accordance with the provisions of item (I) of article (61) and item (iii) of article 73 of the constitution.
The president of the republic approved on 22 April 2012 the following act: No. (32) 2012.
Act of the first amendment of university service act, No. (23) 2008
Article (1)
Repeal article (11) of the act and replaced by the following:
Employee of the university service is referred to retirement when he is up to the age of (65) years.
the minister has the right to extend the service of holder of professorship title for rare specializations, excluding from age condition by a recommendation from the university council to continue his university service with acknowledgement from the relevant medical committee.
The retired who didn’t come back to his job is not included in the privileges provided for in this act and continues to receive his pension.
Employee of the university service who is retired after completing legal age or who are referred for disease reasons by a report of the relevant medical committee or the deceased in service is granted a reward equivalent to his salary for six months salary according to the last salary he received before retirement date.
Holder of doctorate scientific title or equivalent acquired from discreet universities and scientific institutions outside Iraq retains his scientific title when appointed in Iraqi universities and his total salary is calculated as his peers included in university service while his university service outside Iraq is calculated for retirement purposes when appointed in Iraqi universities provided that he serves at least ten years.
Employee of the university service who continues to serve in scientific research in accordance to regulations set by the ministry, is granted allocations of scientific title (15%) for assistant teacher, (25%) for the teacher, (35%) for assistant professor and (50%) for professor of the nominal salary.
Employee of the university service is granted a reward (4,000,000) dinars for each research published in international journals with impact factor that is known universally as a rating for the power of the research and the journal that publishes it, of not less than the world average of date of publication in its specialization.
Service of teaching assistant in Iraqi universities and institutes is considered a university service for retirement purposes since his appointment after obtaining a master’s degree or equivalent, provided that would serve at least ten years later, before reaching the legal retirement age.
Article (2)
Repeal article (12) of the act and replaced by the following:
Employee of the university service or his dependants receive a pension equal to that received by peers of the total salary and university service allocations when referred to retirement in one of the following cases:
If referred to retirement for completing the legal age and has a university service of not less than (10) years.
If referred to retirement for health reasons.
If referred to retirement at his own request, provided that he has a university service of not less than (25) years.
If he died in service.
Article (3)
This act takes effect from the date of its publication in the official gazette.

Binding reasons:
In appreciation for the efforts of Iraqi scientific personnel in Iraq, for the encouragement of scientific research, to set a solid scientific base, to provide opportunities for the support of the members of faculty who have scientific titles, attracting them and to address the subject of their retirement, this act has been enacted.
